Possible Penalties for a DWI Conviction

In Texas, the number of previous DWI convictions can greatly affect the penalties you face for this DWI. We’ve provided general information regarding the penalties you may face (not including penalties imposed by an administrative law judge and higher insurance rates).

First DWI Offense

Jail Time: You face a minimum of 72 hours in jail (six-day minimum jail time if the police found an open container in the vehicle) and a maximum of six months in prison.

Fine: You may receive a fine of up to $2,000.

Community Service: You face a minimum of 24 hours and a maximum of 100 hours of community service.

Criminal Record: You may have a conviction for a Class B misdemeanor on your criminal record.

Second DWI Offense

Jail Time: You face a minimum of 72 hours in jail (six-day minimum jail time if the police found an open container in the vehicle) and a maximum of one year in prison.

Fine: You may receive a fine of up to $4,000 for a second drunk-driving conviction within 10 years.

Community Service: You face a minimum of 80 hours and a maximum of 200 hours of community service.

Driver’s License Suspension: You face a minimum six-month and a maximum one-year suspension of your driver’s license.

Criminal Record: You may have a conviction for a Class A misdemeanor on your criminal record.

Third DWI Offense

Jail Time: You face a minimum of two years in jail and a maximum of 10 years in prison.

Fine: You may receive a fine of up to $10,000 for a third drunk-driving conviction within 10 years.

Community Service: You face a minimum of 160 hours and a maximum of 600 hours of community service.

Driver’s License Suspension: You face a minimum six-month and a maximum two-year suspension of your driver’s license.

Criminal Record: You may have a conviction for a third-degree felony on your criminal record.
